1. Introduction and Acceptance

These Terms & Conditions ("Terms") govern your access to and use of the TommyMeow website located at www.tommymeow.com and all related services, including our AI design generator, print-on-demand apparel ordering, and subscription plans (collectively, the "Service"), operated by TommyMeow ("we", "us", or "our").

By accessing or using the Service, creating an account, or placing an order, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.

We reserve the right to update these Terms at any time. We will notify you of material changes via email or a notice on the website. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

2. Eligibility

  • You must be at least 13 years of age to use the Service.
  • If you are between 13 and 18 years old, you may only use the Service with the consent of a parent or legal guardian.
  • By using the Service, you represent and warrant that you meet these requirements and that all information you provide to us is accurate and truthful.

3. Accounts

3.1 Registration

To access certain features (including placing orders and saving designs), you must create an account. You agree to:

  • Provide accurate and complete information during registration.
  • Keep your login credentials confidential.
  • Notify us immediately at support@tommymeow.com if you suspect unauthorized access to your account.

3.2 Account Responsibility

You are solely responsible for all activity that occurs under your account. We will not be liable for any loss or damage arising from your failure to keep your credentials secure.

3.3 Account Termination

We reserve the right to suspend or terminate your account at our sole discretion if you violate these Terms, engage in fraudulent activity, or engage in conduct that is harmful to other users or to TommyMeow.

4. AI Design Generator — Acceptable Use

Our AI design generator allows you to create custom apparel designs by entering text prompts and/or uploading images. By using the generator, you agree not to submit prompts or upload content that:

  • Is illegal, defamatory, harassing, threatening, or abusive.
  • Infringes on any third party's intellectual property rights (including trademarks, copyrights, or publicity rights).
  • Depicts or promotes sexual content involving minors (strictly prohibited and may be reported to authorities).
  • Promotes violence, terrorism, self-harm, or hatred against any individual or group.
  • Contains private or personally identifiable information about any person without their consent.
  • Violates any applicable local, national, or international law or regulation.

We reserve the right to review, remove, or refuse to generate any design that violates these guidelines without notice. Repeated violations will result in account termination.

5. Intellectual Property

5.1 Your Content

You retain ownership of the text prompts you submit and any original images you upload to the Service. By submitting content, you grant TommyMeow a limited, non-exclusive, royalty-free licence to use, process, and display your content solely for the purpose of providing the Service.

5.2 AI-Generated Designs

Subject to these Terms and our content policy, AI-generated designs created using your prompts are licensed to you for personal and commercial apparel use, including print-on-demand resale. You may not:

  • Claim that an AI-generated design is wholly original human artwork.
  • Use AI-generated designs in a way that infringes third-party intellectual property rights.
  • Redistribute, license, or sell the raw design files (as opposed to the finished printed apparel) to third parties.

For Business plan subscribers, a full commercial licence is included. See Section 8 for plan details.

5.3 TommyMeow's Intellectual Property

All other content on the Service — including our logo, brand name, website design, software, and curated AI Original designs — remains the exclusive property of TommyMeow. You may not reproduce, distribute, or create derivative works from our proprietary content without our prior written consent.

6. Orders, Payments & Fulfilment

6.1 Placing an Order

When you place an order, you are making an offer to purchase a product. We will send you an order confirmation email; however, this does not constitute our acceptance. Your order is accepted when we send a dispatch confirmation email.

6.2 Pricing

All prices are displayed in USD and are inclusive of any applicable taxes unless stated otherwise. We reserve the right to change prices at any time, but changes will not affect orders already confirmed.

6.3 Payment

Payments are processed securely by Stripe. By placing an order, you authorise us to charge the specified payment method. We accept Visa, Mastercard, American Express, PayPal, Google Pay, and Apple Pay.

6.4 Production & Modifications

Because all items are printed on demand, orders cannot be modified or cancelled once they have entered production. Please review your design carefully before completing checkout.

6.5 Failed Payments

If a payment fails, your order will be put on hold. We will notify you and attempt to contact you to resolve the payment issue. Unresolved payment failures may result in order cancellation.

7. Shipping & Delivery

7.1 Estimated Delivery Times

Delivery times are estimates and are not guaranteed. Delays may occur due to customs, carrier disruptions, or circumstances beyond our control.

7.2 Risk of Loss

Risk of loss and title for products pass to you upon dispatch from our fulfilment facility.

7.3 Customs & Import Duties

International orders may be subject to customs duties, import taxes, and fees levied by the destination country. These charges are the sole responsibility of the customer. We are not responsible for delays caused by customs clearance.

8. Subscription Plans & Credits

8.1 Plan Overview

8.2 Billing

  • Paid plans are billed monthly on a recurring basis.
  • Your subscription renews automatically at the end of each billing cycle unless cancelled.
  • You may cancel your subscription at any time; your plan remains active until the end of the current billing period.

8.3 AI Credits

  • AI credits are used each time you generate a design. Credit consumption varies by generation quality and settings.
  • Credits reset at the start of each monthly billing cycle and do not roll over.
  • Unused credits are non-refundable.

8.4 Plan Changes

  • Upgrading your plan takes effect immediately; you will be charged a pro-rated amount for the remainder of the billing cycle.
  • Downgrading your plan takes effect at the start of the next billing cycle.

9. Returns & Refunds

Because our products are custom-printed on demand, we do not accept returns or offer refunds for change of mind.

We will, however, offer a replacement or full refund in the following circumstances:

  • The item arrives defective or damaged.
  • The item received differs significantly from the design you approved.
  • The item is lost in transit (after 45 days from dispatch for international orders, or 15 days for domestic).

To request a remedy, please contact us at support@tommymeow.com within 14 days of delivery (or within 14 days of the expected delivery date if the item is lost). You may be asked to provide photographic evidence of the issue.

10. Prohibited Conduct

In addition to the AI generator restrictions in Section 4, you agree not to:

  • Use the Service for any unlawful purpose.
  • Attempt to gain unauthorised access to any part of the Service or its underlying infrastructure.
  • Reverse-engineer, decompile, or disassemble any software used in the Service.
  • Scrape, crawl, or systematically collect data from the Service without our written consent.
  • Introduce viruses, malware, or other harmful code.
  • Use the Service to spam, phish, or engage in unsolicited commercial communications.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted, error-free, or free from viruses or other harmful components.
  • The results obtained from the AI design generator will be accurate, suitable, or meet your expectations.
  • Any defects in the Service will be corrected.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • TommyMeow shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or in connection with your use of (or inability to use) the Service.
  • Our total aggregate liability to you for any claim arising from or relating to the Service shall not exceed the greater of (a) the total amount you paid to TommyMeow in the 12 months preceding the claim, or (b) USD $100.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.

13. Indemnification

You agree to defend, indemnify, and hold harmless TommyMeow, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including any intellectual property or privacy right; or (d) any content you submit, post, or transmit through the Service.

14. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable law. Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation. If a resolution cannot be reached within 30 days, the dispute shall be subject to binding arbitration or the jurisdiction of competent courts, as applicable in your region.

15. Miscellaneous

  • Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and TommyMeow regarding the Service.
  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
  • Waiver: Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
  • Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights to any successor.
